HC-KAR NC: 2025:KHC:49705-DB RP No. 162 of 2025
THIS RP IS FILED UNDER ORDER 47 RULE 1 CPC R/W SEC.114 OF CPC, PRAYING TO REVIEW THE JUDGMENT AND ORDER, DATED 12.09.2024 (ANNEXURE-A), PASSED BY THIS HON'BLE COURT IN WP 15337/2024 AND TO RECONSIDER AND DISPOSE OFF THE SAID WRIT PETITION IN THE LIGHT OF THE FACTUAL AND LEGAL CLARIFICATIONS PROVIDED HEREIN.
THIS PETITION, COMING ON FOR ORDERS, THIS DAY,
JUDGMENT WAS DELIVERED THEREIN AS UNDER:
CORAM: HON'BLE MRS. JUSTICE ANU SIVARAMAN and HON'BLE MR. JUSTICE G BASAVARAJA
ORAL JUDGMENT (PER: HON'BLE MRS. JUSTICE ANU SIVARAMAN)
1. We have heard the learned counsel on either side. Learned Additional Government Advocate raises a contention that the prayer made by the respondent herein before the Tribunal was only for regularisation from the date on which he completed ten years of service. However, in the judgment in the writ petition by which the order of Tribunal was set aside, the direction issued, is to regularise the services of the petitioner with effect from 03rd June, 1985 with all consequential benefits.
Learned Additional Government Advocate submits that the request of the petitioner before the Tribunal being only for regularisation with effect from the date on which he completed ten years of service, he would be entitled for regularisation only from 03rd June, 1995.

2. Learned counsel for the respondent submits that the prayer in the Original Application is for regularisation of service from the date on which the respondent completed ten years of service and that the said prayer in the review petition is not opposed.
3. In the above view of the matter, Review petition is allowed in part to a limited extent. The Order under review is reviewed and corrected to the limited extent of directing that
"the regularisation of services of the petitioner will be with effect from the date on which he completes ten years of service, i.e. ten years from 03rd June, 1985, with all consequential benefits".
4. Four weeks’ time from today is granted to comply with the direction contained in the judgment.
