1. Mr. Bhuwan Bhatt, learned counsel for the applicant.
2. Mr. Pankaj Joshi, learned AGA with Mr. Himanshu Sain, learned Brief Holder for the State.
3. The present applicant “Bala, daughter of Zaher Singh” is praying for regular bail in relation to First Information Report dated 09.10.2024 bearing FIR No. 0638 of 2024, Police Station – Patel Nagar, District – Dehradun wherein present applicant along with one another Digvijay Singh were implicated for the offences punishable under Section 143 (3) and 143 (5) of BNS, 2023.
4. It is contended by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated and applicant is languishing in jail since 09.10.2024. He further submits that in FIR No. 137 of 2023 pertaining to U.P. Gangsters Act, applicant has been acquitted by judgment dated 21.11.2023 and in another case, pertaining to Immoral Trafficking (Prevention) Act applicant is already bailed out. He further submits that merely on the basis of these two previous criminal cases, applicant has been implicated in the present case. He further submits that applicant is a widow and having two children and both of them are residing with her. He further submits that applicant being a widow cannot be denied bail merely on the ground she has two criminal cases, one in which she is bailed out and in another she is acquitted.
5. On the other side, Mr. Pankaj Joshi, learned AGA, have not disputed this fact that since the charge sheet has already been filed, therefore, there is no need of custodial interrogation of the applicant and in two criminal cases, in one she is bailed out and in another one she is acquitted.
6. After hearing the arguments of learned counsel for the parties and further taking into
consideration the fact that since the charge sheet
2025:UHC:7147 has already been filed, therefore, there is no need of custodial interrogation of the applicant and applicant is languishing in jail since 09.10.2024 and in two criminal cases, in one she is bailed out and in another she is acquitted, this Court is of the view that the applicant deserves for bail.
7. Accordingly, without expressing any opinion on the merit of the case the bail application is allowed.
8. Let the applicant “Bala, daughter of Zaher Singh” be released on bail on furnishing her personal bond and two sureties each of the like amount to the satisfaction of the court concerned.
9. It is made clear that if the applicant is indulged in future in any criminal activity, then the prosecution is free to move the application for cancellation of present bail. It is further made clear that applicant shall join the trial court proceeding on each and every date and she will not seek any unnecessary adjournment.
