No.29 of 2025 on the file of the learned Principal Sub Court, Thanjavur and transfer the same to the Family Court, Coimbatore. Despite service of notice in the Transfer Civil Miscellaneous Petition on the respondent, the respondent/husband neither chosen to appear in person nor through Counsel. No.29 of 2025 from the file of the Principal Sub Court, Thanjavur to the file of the Family Court, Coimbatore. According to the learned counsel for the petitioner, the petitioner being a single lady states that she is seriously prejudiced for being required to travel more than 300 kms between her residence and the Court, where the HMOP No.29 of 2025, has been filed. 3. The grievance expressed by the petitioner are just and reasonable. In fact, I find that the petitioner has also filed a Domestic Violence Petition in DVC. No.130 of 2025, which is also pending before the Chief Judicial Magistrate at Coimbatore. Admittedly, the respondent/husband will have to necessarily attend the said proceedings at Coimbatore and also no serious prejudice would be caused, if the petition is ordered and moreover, the petitioner is a practising Doctor and she will be inconvenienced, if she has to travel 300 kms to attend the every hearing date in the HMOP. 4. In the light of above, this Transfer Civil Miscellaneous Petition is allowed. HMOP. No.29 of 2025 is withdrawn from the file of the Principal Sub Court, Thanjavur and transferred the same to the Family Court, Coimbatore. It https://www.mhc.tn.gov.in/judis TR CMP. No.915 of 2025 __________ Page3 of 4 is made clear that physical presence of both the petitioner and the respondent shall ordinarily be dispensed with, except where their presence is absolutely necessary (for examination of chief and cross).
