1. Heard Mr. S. Chauhan, learned counsel for the petitioner. Also heard Mr. K. Baishya, the learned Additional Public Prosecutor for the State of Assam, who has produced the Case Diary of CID P.S. Case No.01/2022 and has submitted that though the petitioner has appeared before the Investigating
Page No.# 2/3 Officer and his statement has been recorded, however there are sufficient incriminating materials against the petitioner.
2. On the other hand, the learned counsel for the petitioner has submitted that the petitioner is ready to further co-operate in the investigation and he has already appeared before the Investigating Officer in pursuant to the directions of this Court.
3. I have considered the submissions made by the learned counsel for both the sides and have perused the Case Diary of CID P.S. Case No.01/2022. It appears from record that on 10.03.2025, the above named petitioner namely, Sri Bhupen Barman, was granted interim Anticipatory Bail by this Court with certain conditions and it appears that in pursuant to the directions of this Court the petitioner has appeared before the Investigating Officer and has co-operated in the investigation.
4. Though there are incriminating materials against the present petitioner in the Case Diary, however, as he has complied to the directions of this Court and has co-operated in the investigation, the interim bail granted to the petitioner by order dated 10.03.2025 by this Court is hereby made absolute with condition nos. 1, 2, 3 & 4 attached to the said order, remaining intact.
5. With above observations, this Anticipatory Bail application is disposed of.
