I The Court made the following ORDER-- 7 JJ THE HONOURABLE SRI JUSTICE K SREENIVASA REDDY CRIMINAL PETITION ORDER:- NO.1785 OF 2025 This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A19, seeking regular bail, in Crime No.199 of 2022 of Macherla Town Police Station, Palnadu District, registered for the offences punishable under Sections 143,147,148, 448, 427, 436, 323 and 149 lPC. 2. Case of the prosecution, in brief, is that, the defacto COmPlainant iS a resident Of Plot No.303, Pavani Apartment, Macherla and her husband is a Telugu Desam Party Activist. On 16.12.2022, one member of the then opposition party went to attend for a programme, there was clash ensued between the TDP party and YSRCP Party. In that incident, the accused and some others formed themselves into an unlawful assembly and set ablaze the vehicle of TDP Party. Later, they went to society colony and destroyed the TDP Party office. Subsequently, all the accused reached to the apartment of the defacto complainant armed with sticks and stones and damaged the cars and motorcycle which were parked in the parking area and also rushed to the house of the defacto complainant and damaged the furniture. \ . \ 2 I. 3. Heard. Perused the record. 4. On perusal of the material On record goes tO Show that basing on the confessional statement of co-accused, name Of the petitioner herein/A19 is arrayed as accused in the Present Crime. In pursuance to the confessional Statement, the Petitioner herein was arrested on o6.1.2025. Even according to the confessional statement, the accusation as against the petitioner herein is that he is alleged to have procured sticks and other material to the co- accused. Except the said confessional Statement, there iS nO Other material is collected showing the complicity of the petitioner in the present crime. 5. ln view of the aforesaid facts and Circumstances, this Court is inclined to grant bail to the petitioner/A19 on the following conditions. i) The petitioner/A19 shall be released on bail on his executing personal bond for Rs.10,000/-(Rupees Ten Thousand only) with two sureties of the like sum each to the satisfaction of the learned Additional Junior Civil Judge, Macherla. ii) on release" the petitioner shall appear before the Station House Officer concerned, once in a Week i.e., On every Sunday betweeh 10.00 am and 01.00 pm, till filing of the Charge Sheet. \ a--f--<,I_ ., . 6.
