For Petitioner : M/s.M.Yogaa For Respondents : Mr.P.Prithvi Chopda for R1 & R2 Standing Counsel ORDER The petitioner challenges the communication dated 11.12.2024 issued by the second respondent, whereby the petitioner’s application for grant of a licence to carry on business was rejected on the ground that the site where the petitioner had put up a temporary shop falls within a Non-Vending Zone. 2. Learned counsel appearing for the first respondent has placed on record the order dated 10.09.2025 passed by the Hon’ble Division Bench of this Court in W.P. The Division Bench, in paragraph 4 of the said order, has held that since the site is situated in a Non-Vending Zone, the rejection of the petitioner’s application by the respondent Corporation is liable to be sustained on that ground alone. 4. Further, in paragraph 5, the Division Bench observed that the petitioner, being the Managing Trustee of a Charitable Trust, is not entitled to seek a licence/allotment/street vending certificate in the name of the Trust to carry on street vending business, as the same is impermissible under the provisions of the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014. 5. In view of the aforesaid findings of the Division Bench, the issues raised in the present writ petition no longer survive for consideration. 6. Accordingly, the Writ Petition is disposed of. However, as observed by the Division Bench, it is open to the petitioner to submit an application in his individual capacity seeking permission/licence to carry on street vending business.
