1. This is the first bail application filed under Section 483 of Bhartiya Nagrik Suraksha Sanhita 2023 (C.G) for grant of regular bail to the applicant in connection with Crime No. 34/2023 registered at Police Station Balrampur, District Balrampur-Ramanujganj (C.G) for the offence punishable under sections 457, 380, 413, 414/34 of IPC of IPC. 2. As per the prosecution case, a complaint was lodged by one Vinay Yadav to the effect that on 28.03.2023 he came to know that the tower of village Putsura Biyatan is down and when he went to check the tower, he found that the lock was broken, door was opened, nut bolts of the batteries were lying scattered and as many as 24 batteries from the Tower of A.T.C. 2 Infra Pvt. Ltd., worth approximately Rs. 1,73,088/- were stolen by some unknown thief. The Police seized the aforesaid items and also seized the vehicle which was used in the said crime from the other accused. 3. Learned counsel for the applicant submits that other accused namely Vivek Gupta, Faizan Ansari, Ramkumar Singh, Majbullah @ Golwa & Mohd. Siraj Ansari have been enlarged on bail by orders passed in MCRC No. 4345/2023 & MCRC No.6059/ 2023 and also MCRC No.6548/2023 and MCRC No.249/2024. He further submits that the present applicant is in jail since 21.05.2023, the charge sheet has been and the trial is likely to take time, therefore, the applicant may be enlarged on bail, at this stage. 4. Per contra, learned State Counsel opposes the bail application and submits that there are as many as 5 criminal antecedents against the accused. 5.
Considering the custody period of applicant who is stated to be in jail since 21.05.2023 and further the similarly placed co-accused have been enlarged on bail and the trial is likely to take further time, I am inclined to release the applicant on bail at this stage. 6. Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his furnishing a personal bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the trial Court for his appearance before the said Court as and when directed.
