Ms. Rehana Qayoom, learned counsel, with reference to the supplementary affidavit dated 5th June, 2025 filed on behalf of respondent No.2, particularly paragraphs 8, 9 and 13, submits that the proceedings of the re-constituted Board of Officers have since been concluded. And, the recommendations in this regard along with the complete set of proceedings have been forwarded to the Ministry of Defence; vide communication dated June 3rd 2025 for
consideration. She submits that in every possibility the necessary measures/formal orders in this regard shall be passed in the immediate future. Therefore, it is urged that the present petition is rendered infructuous. To this Mr. M. Altaf Khan, learned counsel for the petitioner, as always, fairly submits that the petition be disposed of in terms of the affidavit filed on behalf of respondent No.2 (ibid). However,
liberty be granted to move an appropriate application just in case the matter does not make any tangible progress. In the wake of the above and in terms of the stand set out by the respondents, the proceedings in the present case are closed. The petition is accordingly disposed of. However, in the event, any cause of action still survives, the petitioner shall be at liberty to approach this Court by way of filing an appropriate application.
