JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. The petitioner is before this Court seeking for the following reliefs: a. Issue a writ of certiorari or any other writ quashing the tender (R.F.P.) called by the R9, on behalf of the chief commissioner of B.B.M.P. Bengaluru for providing security guards to schools and colleges of B.B.M.P. south zone and RR Nagara zone, on outsourced basis for a period of 12 months, vide tender notification no. EEP(S)/E-PROCU/24/022- 23, dated 10/03/2023, which is at Ann-5. b. Issue a writ of certiorari or any other writ quashing the tender (R.F.P.) called by the R10, on behalf of the chief commissioner of B.B.M.P., Bengaluru for providing security guards to schools and colleges of B.B.M.P. east zone on outsourced basis for a period of 12 months vide tender notification no. EE/SN/TEND/22/2022-23, dated 13/03/2023 which is at Ann-6. c. Issue a writ of certiorari or any other writ quashing the tender (R.F.P.) called by the R11, on behalf of - 4 - HC-KAR NC: 2025:KHC:54040 WP No. 21428 of 2024 the chief commissioner of B.B.M.P, Bengaluru for providing security guards to schools and colleges of B.B.M.P. west zone on outsourced basis for a period of 12 months vide tender notification no. EE/PW/TEND/14/2022-23, dated 20/03/2023, which is at Ann-7. d. Issue a writ of mandamus or any other writ directing the respondents to call for the fresh tenders for providing security guards to schools and colleges which comes under various zones of B.B.M.P. e. Issue a writ of mandamus or any other writ directing the R1 to consider the representation / proposal letter dated 04/07/2024 given by the petitioner to R1 which is at Ann-24 and to release the arrears of wages to the petitioner as per the minimum wages fixed by the state govt. from time to time under the minimum wages act. f. To take stringent action against the R10 and 10 for violating the interim order of stay passed by this Honble court in WP no. 7697/2023. g. Issue a writ or any other nature of writ or order or direction and grant such other relief in favour of the petitioner as deem fit in the circumstances of the case in the ends of justice and equity. 2. A memo dated 25.11.2025 signed by the learned counsel for the petitioner has been filed, which reads as under; “MEMO FOR WITHDRAWAL The undersigned counsel for the Petitioner hereby most respectfully submits the Respondents have already completed the tender award process and hence the petition has become infructuous. Hence, the Petitioner seeks Permission of this Hon’ble court to withdraw the above Petition. - 5 - HC-KAR NC: 2025:KHC:54040 WP No. 21428 of 2024 Wherefore, this Hon’ble court may kindly be pleased to permit the Petitioner to withdraw the Petition and may kindly be pleased to dismiss the Petition as Infructuous and Withdrawn in the interest of Justice and Equity.” 3.
