Status report by way of an affidavit of Kulwinder Singh, PPS, Deputy Superintendent of Police, Sub Division Mukerian, Distict Hohiarpur has been filed on behalf of respondents No.1 to 4, in compliance of order dated 17.07.2025, which is taken on record. It has been alleged in the status report that an application bearing No.8210-PD dated 16.11.2024 (Annexure P-1) against respondent no.5 to SSP, Hoshiarpur regarding committing obscene/wrong acts, treating her poorly during duty and forcing to do wrong entry in the register and the said application was marked for inquiry to DSP Sub Division Mukerian, Hoshiarpur and it was found in the inquiry that the petitioner submitted applications to education department in respect of subject matter of the above said application and official of the education department are conducting inquiry into the matter and after conclusion of inquiry being KOMAL 2025.07.28 15:58 I attest to the accuracy of this document
CRWP-7591-2025 (O&M) -2- conducted by the officials of education department, the action will be taken in the matter. Therefore, the DSP Sub-Division Mukerian recommended to file the aforesaid application and sent the inquiry report to SSP, Hoshiarpur for further action. Consequently the SSP, Hoshiarpur seen and filed the aforesaid application. It has been further submitted that an application bearing No.3655-PD dated 06.06.2025 (Annexure P-4) to SSP, Hoshiarpur against respondent No.8 and others regarding attacking upon her by unknown persons in the School, defame her, making false allegation against her, quarrelling, abusing, interfering in her duty and giving threats and attack to kill her and the said application was marked for inquiry to the DSP Sub-Division Mukerian. During the inquiry, it was found that the SHO, P.S. Mukerian received application of same subject of above said application submitted by the petitioner and during the inquiry on 02.06.2025 before SHO PS Mukertian, with the intervention of respectable persons, the both parties effected compromise with their free consent.
Now the petitioner has submitted application with a view to harass the respondent Shaminder Kaur and others by moving applications and as such, the DSP Sub-Division Mukerian recommended to file the aforesaid application and sent the inquiry report to SSP, Hoshiarpur for further action. Consequently the SSP, Hoshiarpur seen and filed the aforesaid application. It has been further mentioned in the status report that an application bearing No.360-CC dated 26.05.2025 against respondent Jatinder Kaur and respondent Kulwant Kaur regarding defaming her. The said application was marked for inquiry to SHO, P.S. Cyber Crime, Hoshiarpur and he conducted inquiry into the matter and he found that the petitioner submitted an application to different departments against respondent Jasvir Singh 5/6 months back regarding KOMAL 2025.07.28 15:58 I attest to the accuracy of this document
CRWP-7591-2025 (O&M) -3- levelling allegation of teasing her and thereafter, the education department appointed competent officer to conduct inquiry into the allegations levelled by the petitioner and during the inquiry the allegations levelled by the petitioner were not proved. The respondent Jatinder Kaur sister of respondent Jasvir Singh is also a teacher in Government Elementary School Bhangala and she formed a Whatsapp group alongwith teachers of nearby schools. Whereas, respondent Kulwant Kaur wife of respondent Jasvir Kaur who is also a teacher at Harsa Manser, P.S. Mukerian, Hoshiarpur. The respondent Shaminder Kaur is also teaching with respondent Kulwant Kaur. The respondent Shaminder Kaur was suspicious that her husband Mandeep Singh has illicit relation with the petitioner and on 23.05.2025, respondent Shaminder Kaur kept vigil upon the petitioner through her in-laws family members and thereafter, respondent Shaminder Kaur, Mandeep Kaur, apprehended the petitioner and her husband Mandeep Singh in Firangi Hotel, Himachal Pradesh. The respondent Shaminder Kaur shared some photos of petitioner with respondent Kulwant Kaur on 24.05.2025 who further shared the said photographs with respondent Jatinder Kaur and Jatinder Kaur further shared the said photos on her Whatsapp group.
The photos which were shared by respondent Jatinder Kaur on Whatsapp group were perused in the inquiry and a back of a woman is seen in the photo and no face of any lady is seen in the photo. As such, it is not proved in the inquiry that the said photos are of petitioner. Apart from it, the photos shared by respondent Jatinder Kaur on Whatsapp group are not objectionable nor defaming the petitioner in any form. As per statement of respondent Shaminder Kaur, she and her sister-in-law obtained these photos when respondent Shaminder Kaur had suspicion on her husband Mandeep KOMAL 2025.07.28 15:58 I attest to the accuracy of this document
CRWP-7591-2025 (O&M) -4- Singh and on 23.05.2025 respondent Shaminder Kaur and her in-laws family members apprehended Mandeep Singh and petitioner in Firangi Hotel at Himachal Pradesh. Respect to the same, Shaminder Kaur submitted an application on 29.05.2025 against the petitioner and her husband Mandeep Singh where they admitted their guilt and they agreed not to repeat this wrong act in future. Apart from it, no finding regarding sharing photographs or sharing any comment in respect of respondent Jasvir Singh came to light in the inquiry and due to grudge, the allegations were levelled against Jasvir Singh by the petitioner. Hence, the matter does not call the interference of the police. Hence, DSP-cum-SHO, P.S. Cyber Crime Hoshiarpur recommended to file the aforesaid application and sent the inquiry report to SSP, Hoshiarpur. Consequently the SSP, Hoshiarpur seen and filed the aforesaid application. It has also been specifically mentioned in para No.5 of the status report that it was found in the verification conducted by the local police, there is no danger to the life and liberty of the petitioner at the hands of the private respondents. Keeping in view of the aforesaid status report, no further order is required to be passed and the present petition is disposed of accordingly. (SUKHVINDER KAUR) JUDGE
