For Petitioner(s): Mr.P.Ganesan For Respondent(s): Mr.Ganesh Kumar for R1 Counsel for Government of Tamilnadu (Crl.Side) Mr.N.Ponraj for R2 ORDER This Writ Petition has been filed to direct the 1st respondent to take appropriate action against the respondents 2 to 4 based on the petitioner’s complaint dated 29.03.2025, as transferred for investigation to the 1st respondent vide report dated 24.07.2025 by the Inspector of Police DCB II, Dharmapuri and investigate and remit the deposited amount to the petitioner. 2. Heard the learned counsel appearing for the petitioner, the learned Government Advocate (Crl.Side) appearing for the 1st respondent and the learned counsel for the 2nd respondent and perused the documents placed on record. https://www.mhc.tn.gov.in/judis WP Crl. It is the contention of the learned counsel appearing for the 2nd respondent that already on the complaint lodged by the petitioner, the Deputy Superintendent of Police, Economic Offences Wing, Erode, registered the case in Crime No.2 of 2024 for the offences under Sections 120-B, 409, 420 IPC and Section 5 of TNPID Act, 1997 alleging that the accused had defrauded a sum of Rs.61,43,97,177/- from 398 depositors so far. After completion of enquiry, charge sheet was filed and the same has been taken cognizance in C.C.No.13 of 2025 on the file of the TANPID Court, Coimbatore. While pending trial, the Investigation Officer, namely, Deputy Superintendent of Police, Economic Offences Wing, Erode, filed an application under Section 193(9) of BNSS seeking permission to conduct further investigation on the ground that some of the suspects were left out and they were not included. The accused have committed crime all over Tamilnadu, therefore, in view of the above, application filed by the Investigation Officer in Crl.M.P.No.17 of 2026 was allowed by the trial court by an order dated 02.03.2026, thereby permitted the Investigation officer to conduct further investigation and file additional final report. 4. Considering the fact that the petitioner is also one of the victim, therefore, the petitioner is directed to approach the investigation officer, viz., Deputy Superintendent of Police, Economic Offences Wing, Erode and lodge https://www.mhc.tn.gov.in/judis WP Crl. No. 990 of 2025 __________ Page4 of 5 a complaint, on receipt of the same, the Deputy Superintendent of Police, Economic Offences Wing, Erode is directed to record the statement of the petitioner along with other victims, if any, and file additional final report, as directed by the trial court.
