Heard Mr. K. S. Nanda, learned counsel for the appellant and Mrs. Shweta Singh, learned A.P.P on behalf of the State.
This appeal is directed against the order dated 10.02.2025 passed by learned Additional Sessions Judge-I, Simdega in M.C.A No.75/2025, arising out of AHTU P.S. Case No.04/2015, corresponding to S.T. No.58/2017, whereby and whereunder, the prayer for bail of the appellant has been rejected.
This is a case of misuse of privilege of bail. The appellant was released on bail on 07.04.2016, but he did not appear on 20.02.2023 for recording of the statement under section 313 Cr.P.C., as a result of which, his bail bond was cancelled and warrant of arrest was issued against him. The appellant was apprehended on 18.01.2025 and since then, he is in judicial custody. Regard being had to the period of custody undergone by the appellant, we, while setting aside the order dated 10.02.2025 passed by learned Additional Sessions Judge-I, Simdega in M.C.A No.75/2025, arising out of AHTU P.S. Case No.04/2015, corresponding to S.T. No.58/2017, direct that the appellant, above named, be released on bail, on furnishing bail bond of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Simdega, in connection with AHTU P.S. Case No.04/2015, corresponding to S.T. No.58/2017, subject to the condition that the appellant shall remain physically present before the learned Trial Court on each and every date till the conclusion of the trial. This appeal is allowed.
