ORAL ORDER
1. The Petitioner is before this Court seeking for the following reliefs;
“Wherefore, it is most humble prayed that this hon’ble court may be pleased to appoint an Arbitrator on behalf of the respondent for resolving the disputes between the petitioner and the respondent that have arisen under the agreement of co-ownership dated 08.10.2013, minutes of meeting dated 29.04.2024, 29.05.2024 and 30.05.2024 and the agreement to sell dated 26.12.2024, in the interest of justice and equity.”

A memo dated 27.10.2025 has been filed, signed by the learned counsel for the Petitioner, which reads as under;
“MEMO ON BEHALF OF THE PETITIONER
The undersigned counsel for the petitioner seeks leave of this Hon'ble Court to withdraw the above

petition as the relief sought by the petitioner for appointment of an arbitrator on behalf of the respondent has become infructuous in light of the respondent having nominated an arbitrator from its side and in light of the parties having commenced arbitration proceedings to resolve their disputes. WHEREFORE, it is most humbly prayed that this Hon'ble Court may be pleased to take the Memo on record and pass necessary orders, in the interest of justice and equity.”
