The challenge in this petition is made to the transfer order dated 10.06.2025 by which the petitioner has been transferred from Government Ayurvedic Hospital Kyara, District Derhadun to Government Ayurvedic Hospital Rohida Chamoli. Heard learned counsel for the parties and perused the record. Learned counsel for the petitioner would submit that the petitioner has wrongly been transferred. In order to accommodate the person who have been transferred at the place of the petitioner. He would submit that the petitioner had already worked for more than 12 years in remote area. Therefore, even if he was to be transferred on administrative ground, his option could have been sought and he could have been transferred to the accessible area. He submits that the petitioner may be given liberty to make a fresh representation to the respondents giving his options so that the respondents may consider the transfer of the petitioner in some accessible area preferably in the options given by the petitioner. Learned State counsel would submit that new incumbent has already joined at the place. The petitioner has been transferred on the administrative grounds. He would submit that new incumbents have valid ground for transfer. He gives a statement that the representation that may be given by the petitioner may be decided by the department within three weeks. The writ petition is disposed of with the liberty to the petitioner to make a fresh representation to the respondents giving his place of preferences. In the eventuality of the representation given within a week from today, it shall be decided by the respondents within a period of three weeks thereafter, in accordance with Rules.
