By means of this petition filed under Article 226 of the Constitution petitioner has prayed for salary with effect from 05.09.2007 till 22.06.2021 when he came to be reinstated in service. 3. It is argued on behalf of the petitioner that petitioner though was terminated from employment on 05.09.2007 but upon a writ petition being allowed for reinstatement setting aside the termination order, and thereafter the special appeal of the respondent being partly allowed only to the extent that respondent may pass order afresh and the respondent having reinstated the petitioner with only punishment of withholding three increments and that too without cumulative effect, the respondents could not have withheld the salary of the petitioner for he period he was restrained from discharging duties on account of order of termination passed on 05.09.2007. 4. It is also submitted that in the above regard petitioner has already represented the matter before the competent authority, namely respondent No. 3 on 29.10.2024 claiming salary for the period in question which has remained undisposed of till date. 5. Learned counsel for respondent does not have any objection in the event representation of petitioner is directed to be disposed of by the respondent in accordance with law. 6. In view of the above this petition is disposed of with direction to the respondent no.3 to consider and dispose of the pending representation of petitioner dated 29.10.2024 within a period of two months from the production of certified copy of this order, strictly in accordance with law and by means of a reasoned and speaking order.
