(Oral) Present petition has been filed under Section 482 of BNSS for grant of anticipatory bail to the petitioner in FIR No.62 dated 13.06.2025 under Sections 3/13(1) and 8/13(3) of HGS, GS Act, registered at Police Station Akera, District Nuh. Brief facts of this case are that, on 13.06.2025, police party received a secret information that Irfan @ Tinda and Yunus, were indulging in the cow slaughtering and on that day they were slaughtering cows, in a dilapidated house at village Malab and could be apprehended if raid was conducted. On the basis of the said information, police party reached at the disclosed place and apprehended two persons, who disclosed their names as Asloop and Yunus, whereas one person fled away from the spot. On search 70Kg. of freshly slaughtered cow meat, one axe and other slaughtering weapons were taken into police possession. Accordingly, FIR in question was registered against the petitioner. KOMAL 2025.09.12 17:04 I attest to the accuracy of this document CRM-M-37410-2025 (O&M) -2- Learned counsel for the petitioner contended that the petitioner was not present at the spot and has been falsely implicated in the present case. The petitioner is not connected with the offence in any manner. Recovery in this case had already been effected and nothing is to be recovered from the petitioner. Co-accused Asloop had already been granted regular bail by learned trial Court, vide order dated 27.06.2025. He prayed that custodial interrogation of the petitioner is not required and he is ready and willing to join the investigation and the present petition be allowed. Notice was issued in this case on 17.07.2025 and status report was called from the State, which was filed on 13.08.2025 in the Court and the same was taken on record. Learned State counsel has opposed the petition and submitted that the allegations levelled against the petitioner are grave and serious in nature. The petitioner is actively involved in the commission of crime and as such he is not entitled to the concession of regular bail. Heard. As per the allegations, the petitioner along with other co- accused had indulged in the cow slaughtering. The petitioner was not apprehended at the spot and recovery of 70Kg of cow beef had already been effected in this case. Co-accused Asloop had already been granted regular bail by learned trial Court vide order dated 27.06.2025. There is no chance of tempering with the prosecution evidence as all the witnesses are police officials. Thus, the custodial interrogation of the petitioner is not required for any purpose and no useful purpose would be served by sending the petitioner behind the bars. In the event of his arrest, the petitioner is ordered to be released on bail, on his furnishing bail/surety bonds, to the satisfaction of the Arresting Officer/ Investigating Officer, subject to the conditions, as provided under Section 482(2) of BNSS. It will be open for the Investigating Officer to call the petitioner to join investigation, if so required, by issuing a written notice in this regard and he shall abide by the conditions mentioned in Section 482(2) of the BNSS. However, nothing observed herein above shall be construed to be an expression of opinion on the merits of the case.
