This writ petition has been filed seeking following relief :- "Issue an order or direction directing the learned Additional Civil Judge (Junior Division) Court No. 2, Varanasi to decided the Restoration Application dated 27.02.2019 filed under Order 9 Rule 13 of C.P.C. bearing Misc. Case No. 22 of 2019 titled Smt. Nirmala Devi vs. Malik Ram Dubey and others expeditiously within stipulated period of time as this Hon'ble Court may be pleased to direct considering the facts and circumstances of the case.." 3. Learned counsel for the petitioner submitted that the above-mentioned restoration application is pending consideration since 2019 and the same has not been decided till date. Learned counsel prayed that the same may be decided, expeditiously. 4. Since the above-mentioned restoration application is pending, no useful purpose would be served in keeping this petition pending. 5. In view of the above, this writ petition stands disposed of with a direction to the Additional Civil Judge (Junior Division), Court No.2, Varanasi, to decide the above-mentioned restoration application, in accordance with law, expeditiously, preferably within twelve weeks from the date of production of a certified copy of this order, after ensuring service of notice upon all the respondents and providing opportunity of hearing to all the concerned parties provided there is no other legal impediment.
