Mr. Vikas Pande, learned counsel for the applicant. 2. Mr. Pankaj Joshi, learned A.G.A. for the State. 3. Present applicant Sandeep Joshi, S/o Ramesh Chandra Joshi is praying for regular bail in relation to the FIR dated 28.05.2025, registered as FIR No. 0071 of 2025 at P.S. Kotwali Pithoragarh District Pithoragarh wherein the present applicant along with Nishant Bora were implicated for the offences punishable under Sections 8/21 read with Section 60 of the NDPS Act. 4. In this case, the applicant was taken on remand for the offence punishable under Section 8/21 of the NDPS Act. 5. Learned counsel for the applicant submits that applicant is innocent and has been falsely implicated and the alleged contraband, i.e. charas which is shown to be recovered from the present applicant is below the commercial quantity i.e. 1.07 gram and the applicant has no previous criminal history. He further submits that co-accused, namely, Nishant Bora was already granted bail by this Court. 6. On the other side, Mr. Pankaj Joshi, learned A.G.A. has not disputed that alleged contraband which is shown to be recovered from the applicant is below the commercial quantity and furthermore the applicant has no previous criminal history and he has also not disputed this fact that the co-accused Nishant has already been enlarged on bail. 2025:UHC:5297 7. After hearing the arguments of the learned counsel for the parties and further taking into consideration that the alleged contraband which is shown to be recovered from the applicant is below the commercial quantity and the applicant has no previous criminal history, and the other co-accused has already been enlarged on bail this Court is of the view that the applicant deserves for bail. 8. Accordingly, without expressing any opinion on the merit of the case, the bail application is allowed. 9. Let the applicant Sandeep Joshi, be released on bail on his executing a personal bond and furnishing two reliable sureties of the like amount to the satisfaction of the court concerned.
