2. This is an application under Section 483 of the BNSS, 2023 whereby the petitioner Sri Debojit Bora has prayed for releasing him on bail in connection with Garamur P.S. Case No.04/2025 under Sections 69 of the BNS, 2023.
3. One widow having a child has alleged that after the demise of her husband, her family members were thinking about giving her on marriage again. In the meantime, she came in contact with the present petitioner who wanted to marry her.
4. They had physical relationship also. After that, the petitioner refused to marry her.
5. Mr. Payeng submits that the wife of the petitioner is already dead. He has a daughter and his daughter was against the marriage of her father with the informant.
6. The petitioner has already spent 24 days in judicial custody.
7. I have heard the learned counsel of both sides in the light of the materials available with the record.
8. Considering the aforesaid fact, this Court is of the opinion that the petitioner does not deserve to be detained in custody for any further period of time. His bail application is allowed.
9. It is hereby directed that the petitioner Sri Debojit Bora who was arrested in connection with Garamur P.S. Case No.04/2025 under Sections 69 of the BNS, 2023, shall be released on bail of ₹20,000/- with a surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Majuli. With the aforesaid direction, the bail application is disposed of.
