APHC010082332025 IN THE HIGH COURT OF ANDHRA PRADESH (Special Original Jurisdiction) Between: N Adi Rama Krishnudu The State Of Andhra Pradesh and Others Counsel for the Petitioner: 1. PARTY IN PERSON Counsel for the Respondent(S): 1. GP FOR REVENUE 2. GP FOR FORESTS 3. GP FOR GENERAL ADMINISTRATION 4. GP FOR AGRICULTURE CORAM: THE CHIEF JUSTICE DHIRAJ SRI JUSTICE RAVI CHEEMALAPATI DATE : 19.02.2025 ORDER (Per Sri Justice Ravi Cheemalapati) This writ petition in the nature of Public Interest Litigation filed to set aside G.O.Ms.No.105 WP(PIL)No.37 of 2025 1 IN THE HIGH COURT OF ANDHRA PRADESH AT AMARAVATI (Special Original Jurisdiction) WP(PIL) NO: 37/2025 ...PETITIONER AND Andhra Pradesh and Others ...RESPONDENT(S) Counsel for the Petitioner: Counsel for the Respondent(S): GP FOR GENERAL ADMINISTRATION GP FOR AGRICULTURE CORAM: THE CHIEF JUSTICE DHIRAJ SINGH THAKUR SRI JUSTICE RAVI CHEEMALAPATI 19.02.2025 (Per Sri Justice Ravi Cheemalapati) This writ petition in the nature of Public Interest Litigation filed to set aside G.O.Ms.No.105, Revenue (Lands-VII) Department, dated HCJ & RCJ WP(PIL)No.37 of 2025 IN THE HIGH COURT OF ANDHRA PRADESH [3483] ...PETITIONER ...RESPONDENT(S) SINGH THAKUR This writ petition in the nature of Public Interest Litigation has been VII) Department, dated HCJ & RCJ WP(PIL)No.37 of 2025 2 21.03.2023 being illegal, arbitrary and deprives the very object of the establishment of RARS, Nandyal. 2. Through the impugned G.O., the Government proposed to alienate an extent of Ac.10.00 cents belonging to Regional Agricultural Research Station, Nandyal (for short, ‘RARS’) in favour of Revenue Department on free of cost for the purpose of establishment of integrated Collector’s Complex, by allotting alternate land to RARS at Tangadancha village of Jupadu Bungalow Mandal. 3. The contents of the writ affidavit and the submissions made by the writ petitioner that appeared in person, in nutshell, are that alienation of Ac.10-00 of land proposed under the impugned G.O. results in depletion of irrigated land used for research activities which ultimately would hamper the research activities and consequently larger public interest would be jeopardized. 4. A copy of the common order dated 01.02.2023 passed in W.P.(PIL) Nos. 290 of 2020, 216 of 2021 and 55 of 2022 is made available. HCJ & RCJ WP(PIL)No.37 of 2025 3 5. A perusal of the same shows that the batch of the Public Interest Litigations were filed questioning alienating of Ac.50-00 of land belonging to RARS for construction of a Medical College. Therein also similar contentions and arguments were raised on behalf of the petitioner that alienation of irrigated land used for research activities would hamper the research activities. This Court having observed that the Government vide G.O.Ms.No.53, dated 08.10.2015 had already transferred 500 acres of land at NSC block of Thangadancha State Seed Farm, Kurnool District to Acharya N.G.Ranga Agriculture University on nominal lease, which is suitable for research activity and that similar extent of the land had been transferred at the same location in lieu of transfer of subject land, turned down the objection raised by the petitioner for alienation of the land for the purpose of construction of Medical College. 6. 6. Vide impugned G.O., land in an extent of Ac.10-00 at Tangadancha village of Jupadu Bungalow Mandal was allotted to RARS in lieu of the land proposed for allocation for integrated Collectorate Complex. 7. Further, a perusal of copy of the order dated 05.05.2023 passed by this Court in W.P.(PIL) No.119 of 2021 would indicate that the common HCJ & RCJ WP(PIL)No.37 of 2025 4 orders dated 01.02.2023 passed by this Court in W.P.(PIL) No. 290 of 2020& batch were assailed before the Hon’ble Supreme Court vide SLP Nos.6760- 6762 of 2023 and those Special Leave Petitions were dismissed by its order dated 21.04.2023. 8. The facts of the case on hand stand on similar footing as that of the Public Interest Litigations covered under the common orders passed by this Court referred to supra, which were confirmed by the Hon’ble Supreme Court. 9. In view of the above, this Court finds no merit in this Public Interest Litigation and the same deserves dismissal. 10. Accordingly, the Public Interest Litigation is dismissed. There shall be no order as to costs. Pending miscellaneous petitions, if any, shall stand closed. DHIRAJ SINGH THAKUR,CJ RAVI CHEEMALAPATI,J RR
