The petitioner has preferred instant writ petition for a direction upon the respondent authority to grant appointment to the petitioner as an Assistant Teacher in Junior Basic School of District Maharajganj on the basis of aggregate marks secured by the petitioner in the selection held in pursuance of Government Order dated 15.12.2016 and on the basis of counseling conducted on 05.01.2024 in District Maharajganj within some specified time. On the basis of instructions, which are kept on record, Ms. Archana Singh, learned counsel for respondent nos. 4 & 5, submits that although cut-off marks of the petitioner was 71.10, however, he had qualified TET after the last date of application, i.e., 05.12.2016, therefore, he was not eligible to be considered for being appointed on the post of Assistant Teacher. Learned counsel for the petitioner, on the aforesaid, prays to not-press the writ petition with liberty to challenge the decision of the Committee rejecting candidature of the petitioner. Accordingly, the writ petition is dismissed as not-pressed with the liberty as prayed for. No order as to costs.
