Neutral Citation No. - 2025:AHC:124450 Court No. - 4 Case :- WRIT - A No. - 10429 of 2025 Petitioner :- Durgavati Devi Respondent :- Union Of India And 2 Others Counsel for Petitioner :- Jitendra Yadav Counsel for Respondent :- A.S.G.I.,Ugrasen Kumar Pandey Hon'ble Ajit Kumar,J.
1. Heard learned counsel for the petitioner and learned counsel for the respondent.
2. By means of the this writ petition filed under Article 226 of the Constitution of India, the petitioner has prayed for remedy in the nature of mandamus commanding the respondent no.2 to record the name of the petitioner as a legally wedded wife of respondent no.3, who is government employee.
3. Shri Urasen Kumar pandey, learned Advocate appearing for the respondent no.2 has obtained instruction in the matter, which have been placed before this Court and as per the instructions, it transpires that the petitioner's name is continued to be recorded as wife of late Ram Singh in the official record of the service book and there is no question of her name being deleted.
4. I find that the name of Durgawati is shown as wife of Ram Singh in the details of family recorded in the service records.
5. In the circumstances, therefore, I find that this petition to be based on apprehension as no person recorded as wife can be deleted from official record so long as she remains alive without notice to her.
6. It goes without saying that if legally wedded wife is recorded in the service record of her husband, in the event her name is sought to be deleted from the official record, the concerned authority will always be putting such legally wedded wife to notice before taking any action.
7. Subject to the observation made above, this petition is consigned to record. Order Date :- 25.7.2025 Pravesh Mishra Digitally signed by :- PRAVESH KUMAR MISHRA High Court of Judicature at Allahabad
