The applicant- Ayan is in judicial custody in Case Crime No.125 of 2025, registered at Police Station Sitarganj, District Udham Singh Nagar under Section 3, Section 5 read with Section 11(1) of the Uttarakhand Protection of Cow Progeny Act, 2007. 2. According to the First Information Report dated 10.05.2025, the police party received a secret information that one person is selling beef. The police party raided the spot. The police party observed that three persons were present on the spot. Seeing the 1 2025:UHC:5073 police, one person managed to escape from the spot. The police party recovered 40 kg of beef and other articles from the spot. The present applicant and one co-accused Sajid were arrested. 3. Heard Mr. Faizan Ali, learned counsel for applicant and Mr. G.S. Sandhu, learned Additional Advocate General for State. 4. Mr. Faizan Ali, Advocate, submitted that the applicant has been falsely implicated in the present matter. There was no independent witness to the alleged recovery. Applicant does not have any criminal antecedents. The co-accused Sajid has been released on regular bail by the trial court. 5. Mr. G.S. Sandhu, learned Additional Advocate General, has opposed the bail application orally. 6. Having considered the submissions of learned counsel for both the parties and in the facts and circumstances of the case, without expressing any opinion as to the merit of the case, this Court is of the view that the applicant deserves bail at this stage. 7. The Bail Application is allowed. 8.
