Petitioner has been made an accused in connection with S.T. Case No. 04 of 2024 arising out of R.I.T. P.S. Case No. 99 of 2023 for the offences registered under section 395 of the Indian Penal Code, pending in the court of learned Additional Sessions Judge-I, Saraikella-Kharsawan.
Bail application of the petitioner was earlier rejected by this court vide B.A. No. 2275 of 2024 by order dated 23.04.2024.
On 11.09.2023, the Informant was waylaid by five persons near Railway Crossing, Lochapur. Accused person looted mobile phone and other articles from the Informant. Passerby revealed the name of the dacoits.
It was submitted that the name of the petitioner has been spelt out by the passerby whose identity has not been revealed in the FIR. It was submitted that petitioner is in custody for more than 16 months. It was further submitted that similarly situated co-accused has been granted bail by this court earlier.
Regard being had to the facts and circumstance of the case, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Saraikella-Kharsawan in connection with S.T. Case No. 04 of 2024 arising out of R.I.T. P.S. Case No. 99 of 2023.
