Appellant- Pushpendra Singh has filed this appeal under Section 413 of B.N.S.S., 2023 to challenge the impugned judgment and order dated 17.04.2025 passed by Session Judge, Kannauj in Criminal Appeal No.67 of 2024, titled Neeraj Vash Vs. State of U.P. and others, arising out of Criminal Case No.134 of 2024 in Case Crime No.235 of 1998, under Sections 324, 452, 504 and 506 IPC, registered at Police Station Saurikh, District Kannauj, whereby while reversing the judgment of conviction dated 30.8.2024 passed by Civil Judge (J.D.), Kannauj, the accused- opposite party no.2 has been acquitted. During the course of hearing, when learned counsel for the appellant-complainant is confronted with the maintainability of the appeal preferred against the judgment of acquittal passed by the appellate court, he prays for withdrawal of the appeal to avail the appropriate statutory remedy. The appeal is dismissed as withdrawn. Office is directed to return the certified copy(s), if any, to the learned counsel for the appellant.
