Learned counsel for the petitioner submits, while pointing out to the representations at Annexures-F and G given by the petitioner to the Deputy Commissioner and the Assistant Commissioner that some persons belonging to the village in Yelemaddlu are trying to take

HC-KAR NC: 2025:KHC:36718 WP No. 27968 of 2025 possession of 2 acres of land belonging to the petitioner in Sy.No.17 of Yelemaddlu Village, Medunda Hobli, Koppa Taluk, Chikkamagaluru District, while also requesting the revenue authorities to take over the property as if it is a government property. The petitioner is therefore seeking a writ of mandamus directing the respondent -Deputy Commissioner and the Assistant Commissioner to consider the representations given by the petitioner and ensure that there is no encroachment caused on the land belonging to the petitioner.
3. Learned High Court Government Pleader raises an objection that the petitioner is making allegations about some private parties, but they are not impleaded in the writ proceedings. There is nothing on record to show the revenue authorities are seeking to take over the property.
4. There is substance in the submission made by the learned High Court Government Pleader, the petitioner will get a cause of action only if the revenue authorities

HC-KAR NC: 2025:KHC:36718 WP No. 27968 of 2025 seek to take over the property either by issuing notice or without issuance of notice. At any rate, the revenue authorities herein will not be permitted to disturb the peaceful possession of the petitioner without taking recourse to law. On the other hand, if encroachment is anticipated at the hands of the private individuals, then the remedy for the petitioner lies before the civil Court. With these observations, the writ petition stands
