THE APPEAL COMING ON FOR CONCILIATION BEFORE LOK ADALAT, THE FOLLOWING CONCILIATION ORDER IS PASSED: CONCILIATION ORDER This appeal is filed assailing the order dated 13.09.2022 in W.P. No.24370/2019 by the learned Single Judge. The learned Single Judge has disposed of the writ petition in terms of the impugned order. 2. The KSRTC is in appeal against the order passed by the learned Single Judge. 3. Learned counsel for the appellant and the learned counsel for the respondent are present. 4. Learned counsel for the appellant/KSRTC and respondent/employee jointly submit that the dispute is amicably settled and the parties have reduced the terms of the settlement in the joint memo. 5. The joint memo reads as under:- "JOINT MEMO The WA filed against the order passed by the Learned Single Judge in WP.No.24370/2019 dated 13.9.2022 has been 3 settled between the parties on the following terms and may kindly be modified as under: 1. The petitioner Corporation agreed to reinstate the Respondent workman into service with continuity of service and without backwages from the date of dismissal till the date of actual reinstatement and by withholding 3 increments as per the award passed in Application 10(4A) No. 1/2017 dated 12.10.2018. 2. The petitioner Corporation will also issue SOP as directed by the Learned Single Judge in WP. No.24370/2019 dated 13.9.2022. 3. SOP is effective from the date on which it is issued, same is prospective, applicable to the disciplinary cases initiated after the date of issue of SOP and the same is not applicable to pending ID cases/WP and also orders of punishment passed prior to the date of 50P. 4. The parties to the proceedings have agreed for the above terms." 6. This Court does not find any impediment to accept the terms of the settlement. Accordingly, the impugned judgment dated 13.09.2022 in W.P. No.24370/2019 by the learned Single Judge is modified in terms of the settlement. Sd/- JUDGE Sd/- MEMBER CHS
