The above petition has been filed seeking orders to condone the delay of 98 days in preferring the appeal, challenging the order passed in C.M.A.No.03 of 2018 dated 22.02.2024 on the file of the Sub Court, Thoothukudi, confirming the order passed in E.A.No.174 of 2012 in E.P.No.27 of 2010 in R.C.O.P.No.5 of 2007 dated 25.09.2014 on the file of the Principal District Munsif Court, Thoothukudi.

When the matter is taken up today, the learned counsel appearing for the petitioners filed a memo dated 03.07.2026 stating that the second respondent remained ex-parte both before the Executing Court as well as before the first appellate Court and hence, notice to her may be dispensed with. The said memo is recorded.
3. Heard the learned counsel appearing for the petitioner and the learned counsel appearing for the first respondent.
4. Considering the facts and circumstances and taking note of the reason assigned and also the quantum of delay, this Court is inclined to condone the delay.
