NARENDRA PRASAD ORAL ORDER This writ petition is filed under Articles 226 & 227 of the Constitution of India, challenging the suspension order, dated 02.05.2024, vide Annexure-H, passed by the first respondent. 2. The petitioner was appointed as a Waterman in the fourth respondent – Grama Panchayat. His service was regularized in the year 2007 and he has been promoted as a Bill Collector in the year 2022. At that time, an enquiry was initiated against the petitioner, charge memo has been issued and thereafter, the impugned suspension order has been passed on 02.05.2024 vide Annexure-H. Even after one year of the issuing of the suspension order, enquiry is not completed. Therefore, the petitioner submitted a representation dated 17.01.2025 vide Annexure-J, seeking reinstatement of the petitioner into service. - 3 - HC-KAR NC: 2025:KHC:30792 WP No. 4565 of 2025 3. The learned counsel for the respondents submit that the enquiry against the petitioner has already been initiated and enquiry is under progress and within three months, the enquiry will be completed. He further submits that during the period of suspension the respondents are paying the subsistence allowance to the petitioner. 4. In view of the above, this writ petition is disposed of. Further, if the respondents have not concluded the enquiry within three months, the respondents are hereby directed to consider the representation of the petitioner, dated 17.01.2025 vide Annexure-J, for re-instatement of the petitioner into service, in accordance with law.
