The present regular first appeal has been filed impugning the judgment and decree dated 12.08.2015 passed in O.S.No.5661 of 2009 by the appellant/plaintiff.
2. The learned counsel for the appellant restricts his challenge in the present appeal to the award of interest at the rate of 10% per annum on the decreetal amount.

2. The plaintiff has filed the suit for money decree of Rs.14,94,420/-. The learned Trial Court has decreed the suit for the said sum of Rs.14,94,420/- with interest at the rate of 10% from the date of suit till realization of amount.
3. The learned counsel for the appellant/plaintiff submits that money was due and payable by the defendants in a commercial transaction and therefore, the rate of interest should have been awarded at 18% p.a. on Rs.14,94,420/- till the
judgment and decree and thereafter, 18% future interest till the awarded sum was paid.
4. We have considered the submissions.
5. Section 34 of the Code of Civil Procedure provides for payment of interest by the Court on a decreed sum. Section 34 of CPC reads as under:
"34. Interest.- (1) Where and in so far as a decree is for the payment of money, the Court may, in the decree, order interest at such rate as the Court deems reasonable to be paid on the principal sum adjudged, from the date of the suit to the date of the decree, in addition to any

HC-KAR NC: 2025:KHC:44536-DB RFA No. 1495 of 2015 interest adjudged on such principal sum for any period prior to the institution of the suit, with further interest at such rate not exceeding six per cent, per annum, as the Court deems reasonable on such principal sum, from the date of the decree to the date of payment, or to such earlier date as the Court thinks fit: Provided that where the liability in relation to the sum so adjudged had arisen out of a commercial transaction, the rate of such further interest may exceed six per cent, per annum, but shall not exceed the contractual rate of interest or where there is no contractual rate, the rate at which moneys are lent or advanced by nationalized banks in relation to commercial transactions. Explanation I. .xxxx Explanation II.- For the purposes of this section, a transaction is a commercial transaction, if it is connected with the industry, trade or business of the party incurring the liability.
6. Plaintiff is an Medium, Small and Micro Industries (MSME). Petitioner is not in the business of money lending and therefore, the petitioner cannot claim that the petitioner should be allowed the interest, which the bank charges on commercial transactions. We therefore do not find that the learned Trial Court has committed an error in awarding the interest at the rate of
