Jagarnathpur, District, Jharkhand. … … Petitioners Versus The State of Jharkhand. … … Opposite Party ------ CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Rishu Ranjan, Advocate For the State : Mr. Rakesh Ranja, APP ----- 06/ 09.07.2025 Heard the parties. 2. This anticipatory bail application under Section 482 & 484 of BNSS, 2023, has been preferred by the petitioner apprehending his arrest in connection with Dhanbad P.S. Case No.358 of 2024, for offences under Sections 140(2) of the B.N.S., 2023. The case is presently pending before the Court of learned Chief Judicial Magistrate, Dhanbad. 3. Learned counsel representing the petitioner submits that this is not a case of kidnapping. He submits that the employer of this petitioner had given loan to the victim year back but since the informant was not returning the same, they have gone to collect the amount for which this false case has been lodged. 4. The learned APP opposes the prayer of the petitioner for grant of anticipatory bail. 5. After going through the case diary and the statement of the witnesses and the victim also, it is clear that the victim was recovered from Ranchi. One of the co-accused-Sourav Singh has confessed about giving money to the victim but stated that since 2025:JHHC:18444 2 the victim is not paying back the money, they planned to kidnap the victim and then recover the money. This petitioner was one of the person who is involved in this occurrence and has been named by the victim himself. 6. Considering the aforesaid facts, this is not a fit case to grant anticipatory bail to the petitioner, at this stage, the same is dismissed. (ANANDA SEN, J.) Sandeep. Cp-3
