CRL.M.C. 128/2018 1. The petitioners, by the present petition, seek quashing of FIR No.428/2012 under Section 498A/406/34 IPC, Police Station Krishna Nagar, registered on the complaint of respondent No.2. 2. The petitioner No.1 is the husband of the respondent No.2. The petitioner Nos.2 and 3 are the parents of the petitioner No.1. The subject FIR emanates out of a matrimonial discord between the petitioner No.1 and the respondent No.2. It is contended that the parties have settled their disputes through the process of mediation held at Delhi Mediation Centre, Karkardooma Courts, Delhi. As per the settlement, the petitioner had to pay to the respondent No.2, a total sum of Rs.18,00,000/-, out of which, Rs.12,00,000/- has already been paid to the respondent No.2. CRL.M.C. 128/2018 Page 2 The parties have dissolved their marriage by way of a decree of divorce by mutual consent. Balance amount of Rs.6,00,000/- has been handed over to the respondent No.2 in Court by way of Bankers Cheque Nos.69912, 69911 dated 14.12.2017 drawn on Canara Bank and Bankers Cheque No.7631 dated 14.12.2017 drawn on Axis Bank. 3. The respondent No.2, who is present in person and is represented by her counsel and is also identified by the Investigating Officer, confirms that she has settled with the petitioner and further confirms that she does not wish to press any charges against the petitioner. 4. In view of the settlement between the parties and the fact that the marriage between the respondent No.2 and the petitioner No.1 has already been dissolved by way of a decree of divorce by mutual consent and further all disputes between the petitioners and the respondent No.2 have been amicably settled and the respondent No.2 does not wish to prosecute the complaint any further, in my view, the ends of justice would be served in quashing the FIR No.428/2012 under Section 498A/406/34 IPC, PS Krishna Nagar and the consequent proceedings emanating therefrom. 5. In view of the above, FIR No.428/2012 under Section 498A/406/,34 IPC, PS Krishna Nagar and the consequent proceedings emanating therefrom are quashed. 6.
