APARESH KUMAR SINGH Order 23/04/2025 The petitioner Nos.1 and 3 had lodged a complaint against petitioner No.2 under Sections 318, 115(2), 304(2) & 351 of BNS, 2023 bearing Amtali PS Case No.2025 AMT 022 on 03.03.2025. Petitioner No.2 was also arrested and later on released on bail by the learned trial Court. Petitioner Nos.1 and 3, along with petitioner No.2, have joined together to seek quashing of the FIR as they have reached a settlement. However, joining of the complainant and the accused to seek quashing of an FIR is not acceptable to the Court. Therefore, learned counsel for the petitioners seeks permission to withdraw the instant criminal petition with a liberty to file a fresh petition on behalf of the accused for quashing of the instant FIR and arraigning the informant as the respondent. Liberty is granted. Accordingly, the instant petition is dismissed as withdrawn. Pending application(s), if any, shall stand disposed of.
