MENGDEY Date : 11/09/2025 ORAL ORDER 1. The present application is filed by the Applicant for enlarging him on Parole leave on the ground of providing financial assistance to the family. 2. Heard learned Advocate for the Applicant and learned APP appearing on behalf of the Respondent - State. 3. Rule returnable forthwith. Learned APP waives service of Rule on behalf of the Respondent State. 4. Learned Advocate for the Applicant has submitted that the Applicant had approached the concerned authority praying for Parol Leave. However, the said Application was dismissed by the authority concenred vide order dated 25.08.2025 and thus the Applicant has preferred the present Application on the ground that the family of the Applicant is facing dire financial distress and therefore the presence of the Applicant is required for the purpose of financial assistance to the family. 5. Learned APP has opposed the Application and submitted to dismiss the R/SCR.A/11752/2025 ORDER DATED: 11/09/2025 Application. 6. Having heard the arguments advanced by the learned Advocate for the Applicant and the ground mentioned in the Application so also the fact that the Applicant has undergone incarceration for a period of more than 14 Years, this court is inclined to exercise discretion in favour of the applicant. 7. The application is allowed. The Applicant - ABDUL @ REHMANBHAI ISMAILBHAI SHEIKH is ordered to be released on Parole Leave for a period of 7 Days from the date of actual release, upon furnishing a personal bond of Rs. 5,000/- (Rupees Five Thousand only) with a surety of the like amount to the satisfaction of the jail authority, and on a further condition that the Applicant shall surrender to the Jail authorities on expiry of the Parole period. 8.
