Heard learned Counsel Mr. A.W.Aman for the petitioner, Shamim Ahmed who has filed this application under Section 482 of the BNSS, 2023 with a prayer for pre-arrest bail as he is apprehending arrest in connection with Murajhar PS Page No.# 2/2 Case No. 231/2024 under Sections 80/108/3(5) of the BNS, 2023. 2. Mr. D.P.Goswami, learned Addl.Public Prosecutor is present for the respondent State and Mr. S.Dey, learned counsel is present for the informant. 3. An affidavit has been filed on behalf of the informant and it is submitted by the learned counsel for the informant that there are allegations of assault and harassment in the FIR and no case of sexual assault has been registered against the petitioner. The learned counsel has vehemently opposed the bail prayer of the petitioner. 4. I have considered the submissions at the Bar with circumspection. 5. I have scrutinized the Case Diary. 6. The merit of this case are not brought to the fore as investigation is still under progress. The petitioner was granted interim bail on 10.02.2025 by a co- ordinate Bench of this court. 7. Case Diary reveals that the petitioner has appeared before the I.O. and his statements has been recorded. He has not violated the bail conditions.
