Heard Sri Mahabir Yadav, learned counsel for the applicant and Sri D.P.S. Chauhan, learned A.G.A. for the State. 2. The instant application has been filed to release the applicant on bail in case crime no. 83 of 2025, under Sections 109(1), 351(2) BNS, P.S. Pannuganj, District Sonbhadra. 3. Contention of learned counsel for the applicant is that though in the F.I.R. general allegation has been made against all the accused persons, including the applicant, in the statement of the injured Ajeet Prajapati, specific role of causing injury with an axe has been assigned to the present applicant. It is further submitted that applicant has been falsely implicated and the co-accused Dilip has already been released on bail by this Court in Bail Application No. 21393 of 2025. Charge sheet has already been filed, therefore, there is no requirement of custodial interrogation. 4. Per contra, learned A.G.A. vehemently opposed and submitted that the applicant has been assigned specific role of causing injury to the injured with an axe, therefore, he is not entitled to be released on bail. 5. Considering the aforesaid submissions of learned counsel for the parties and on perusal of record, it is clear that injured Ajeet Prajapati has made specific allegation against the applicant for causing injury with axe and his injury is substantiated by the injury report and role of the Versus Counsel for Applicant(s) : Ajay Kumar Pandey, Mahabir Yadav Counsel for Opposite Party(s) : G.A. Vimlesh .....Applicant(s) State of U.P. .....Opposite Party(s) applicant is distinguishable from the co-accused Dilip. 6. In view of the above, this Court is not inclined to release the applicant on bail. Accordingly, the bail application is rejected.
