Learned counsel appearing for the petitioner files a memo seeking withdrawal of the petition. The memo so filed reads as follows:

"MEMO FOR WITHDRAWAL
1. The 3rd Additional Civil Judge and JMFC at Bhadravathi has on 19.07.2024 allowed the IA No.X filed by the Plaintiff (Petitioner herein) under Order 23 Rule 1 (3) seeking permission of the Court to withdraw the suit in OS No.200/2017 with liberty to file fresh suit.
Therefore the suit in OS No.200/2017 on the file of the 3rd Additional Civil Judge and JMFC at Bhadravathi has come to be
disposed off, and in the result the present writ petition arising from the same has become infructuous.
2. Therefore, on behalf of the petitioner it is submitted that the petitioner may be permitted to withdraw the present writ petition, as the same has become infructuous."
In terms of memo, the petition is disposed as withdrawn.
