1. Heard Sri Prabhav Srivastava, learned counsel for petitioners and Sri R.S. Chauhan, Advocate for Respondents-2 and 3.
2. Petitioners have claimed that they are working at Moradabad Development Authority as Group ‘D’ employees for last many decades and they want that their case for regularization be considered in terms of U.P. Regularization of Persons Working on Daily Wages or on Work Charge or on Contract in Government Departments on Group “C” and Group “D” Posts (Outside the Purview of the Uttar Pradesh Public Service Commission), Rules, 2016 (hereinafter referred to as “Rules, 2016”), which was adopted by Respondent-Moradabad Development Authority by a resolution dated 21.12.2017. However, at this stage, Court is not aware, whether State has granted approval or not.
3. Learned counsel for petitioners, on basis of documents available on record, submits that petitioners are still working and they have complied the pre-conditions for regularization as referred in aforesaid Rules, 2016.
4. Learned counsel appearing for Respondents-2 and 3 by referring documents annexed alongwith this writ petition submits that Moradabad Development Authority is a self financed body and it may be a factor that even after adoption of Rules, 2016,
petitioners’ claim may not be considered.
5. In aforesaid circumstances, instead of going into merit of case at this stage, whether petitioners have substantive claim for regularization or not, this writ petition is disposed of with observation that in case petitioners submitted a copy of this writ petition to concerned respondent, their respective grievance will be looked into and in case of any legal impediment, the same will be communicated to petitioner within a short period.
