ORAL ORDER
This petition is filed by accused No.3 under Section 439 of Cr.PC praying to grant bail in Crime No.273/2022 of Kunigal Police Station registered for the offences punishable under Sections 307, 324, 341, 504, 149 IPC.
2. Heard the learned counsel for petitioners and the learned High Court Government Pleader for the respondent/State.

learned counsel for petitioner would contend that, the petitioner was earlier granted bail in Crl.

Misc. No.1770/2022, and he has been released on bail on
12.12.2022. As the petitioner could not appear in the case, the Trial Court has issued NBW, and he has been secured by executing NBW on 21.07.2025, and since then, he is in judicial custody. The petitioner undertakes to appear before the Trial Court on all dates of hearing and cooperate for speedy disposal of the case. The petitioner has now deposited a sum of Rs.50,000/- towards forfeited bond amount. With this, he prayed to allow the petition.
4. Per contra, the learned High Court Government Pleader for the respondent/State would contend that, due to the absence of this petitioner, the case registered against him could not be disposed of. If the petitioner is again granted bail, he will again remain absent, and it will prolong the disposal of the case. With this, she prayed to reject the petition.

5. Having heard the learned counsel, the Court has perused the materials placed on record.
6. The petitioner has been arrayed as accused No.3 in Crime No.273/2022 of Kunigal Police Station, and charge sheet has been filed for the offences punishable under Sections 307, 324, 341, 504 and 149 of IPC. The
learned counsel for petitioner now submitted that the case against the petitioner has been committed to Sessions Court, and pending in SC No.168/2025. The petitioner earlier had been granted bail by order dated 30.11.2022 passed in Crl.Misc. No.1770/2022, and he has been released on 21.12.2022. The petitioner again remained absent, and NBW has been issued against him, and he has been secured on 21.07.2025, and since then, he is in judicial custody. The petitioner has now undertaken to appear before the Trial Court on all dates of hearing, unless exempted and co-operate for speedy disposal of the case. The petitioner also deposited a sum of Rs.50,000/-

towards forfeited bail bond of Rs.1,00,000/-. and the said amount deposited has to be appropriated to the State.
7. Considering the above aspects, the petitioner has made out a case for grant of bail with conditions. In the result, the following:
ORDER
i) The petition is allowed.
ii) The petitioner is granted bail in Crime No.273/2022 of Kunigal Police Station pending in SC No.168/2025 subject to following conditions.
a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with one surety for the like sum to the satisfaction of the Trial Court.
b) The petitioner shall not tamper the prosecution witnesses either directly or indirectly.

c) The petitioner shall attend the Trial Court on all dates hearing, unless exempted, and co- operate for speedy disposal of the case.
The amount of Rs.50,000/- deposited by the petitioner shall be appropriated to the State towards forfeited bond amount. Sd/- (SHIVASHANKAR AMARANNAVAR) JUDGE
