Heard the parties.
The petitioner has been made accused in connection with Angara P.S. Case No.102 of 2023 registered under Sections 419, 420, 423, 465, 467, 468, 471, 120B of the Indian Penal Code.
Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner is the witness to the sale deed executed in favour of Ashok Kumar by the co-accused Pawan Kumar, in respect of the land, the ownership of which is claimed by the complainant. It is submitted that the allegation against the petitioner is false. It is next submitted that the dispute between the parties is at best a civil dispute. It is next submitted that there is no allegation of any impersonation of the vendor of the sale deed or power of attorney holder. It is also submitted that the co-accused, with similar allegations, has already been released on bail by a co-ordinate Bench of this Court vide order dated 27.08.2024 passed in B.A. No.5840 of 2024. It is then submitted that the petitioner undertakes that he will co-operate with the trial of the case. It is lastly submitted that the petitioner has been in custody since 04.12.2024 as is evident from para-01 of the instant bail application. Hence it is submitted that the petitioner be released on bail.
Learned Addl. P.P. opposes the prayer for bail.
Considering the facts of this case, the above-named petitioner is
directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned JMFC, Ranchi in connection with Angara P.S. Case
No.102 of 2023 with the condition that he will co-operate with the trial of the case and furnish his mobile number and photocopy of the Aadhar Card in the court below with an undertaking that he will not change his mobile number during the trial of the case.
