The fact of the matter is that co-accused Bachcha Singh is the own nephew of the Tika Singh and the petitioner no. 2 namely, Krishadeo Singh @ Jaikishun Singh is that son of Tika Singh and from this it is clear that informant and the petitioners belong to same family. He further submits that petitioners have equal share in entire property and Bachcha Singh has transferred his own share of land to the petitioner no. 1, Satendra Singh and others and petitioner no. 2 is said to be the identifier. He further submits that this is a matter of land dispute and simply invoking jurisdiction of the Criminal Court should not be permitted to be used as a weapon to pressurize the petitioners. He further submits that petitioner are in custody since 01.07.2025. Petitioner No. 1 possesses two antecedent whereas Petitioner No. 2 possesses five antecedent. 5.
However, learned APP for the State oppose the prayer for regular bail of the petitioner. 6. On perusal of the FIR and impugned order dated 22.08.2025, it appears that dispute is Prima Facie civil in nature. Considering the aforesaid facts and circumstances of the case and its nature, let the above named petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand)
