Mr. Shivam Raturi, Advocate, holding brief of Mr. Shailendra Nauriyal, Advocate for the petitioners. 2. Mr. Narain Dutt, Standing Counsel for the State of Uttarakhand. 3. Petitioners are Government servant, whose services are transferable. They are serving as Instructor in different Government ITIs. According to them, the institutions where they remained posted for most period of their service career were categorised as durgam at the relevant point of time, but now their category has been changed as sugam, consequently they have been denied benefit of the services rendered at durgam places. 4. Learned State Counsel, however, points out that this writ petition was filed in 2023, not against the order of transfer, but petitioners have sought benefit of services rendered by them at durgam places, which aspect can only be examined by the authorities. 5. This Court do not find any reason to interfere in the matter. Whether petitioners served at durgam places or not and the benefit which they are entitled to can be examined only by the departmental authorities. What weightage is to be given for services rendered in a particular institution also can be seen only by the departmental authorities. 2025:UHC:8261 6. In such view of the matter, the writ petition is disposed of by permitting the petitioners to approach the competent authority by making representation. If they make such representation, the competent authority shall look into the matter and take appropriate decision, as per law.
