ORAL ORDER
1. Mr. Amit Shukla, learned advocate, who appears on behalf of Mr. Nimit Y. Shukla, learned advocate for the applicants submits that at the time of issuance of Rule in the present petition, the petitioners have been protected by this Court with a specific direction to deposit 50% of the cheque amount before the trial court within four weeks from the receipt of the order. Then-after, during the pendency of the present proceedings, the matter has already been amicably settled between the parties. On the strength of the above- stated development took place in the matter, the petitioners do not wish to continue with the present proceedings, hence, they may be permitted to withdraw the present proceedings.
R/CR.MA/22454/2022 ORDER DATED: 05/05/2025 Learned advocate has produced a xerox copy of the written communication made by the Kotak Mahindra Bank Ltd. to the petitioners herein stating that the entire payment has been received by the bank and there are no outstanding dues against the petitioners. The said communication is ordered to be taken on record. On the strength of the above-stated development took place in the matter, the learned advocate does not press this application with a liberty to approach the trial court to get back the 50% amount deposited before the concerned trial court.
2. Permission as prayed for is granted. This application is
disposed of as withdrawn with above liberty without expressing any opinion on the merits of the case. Rule is discharge. Interim-relief granted earlier shall stand vacated forthwith.
