The challenge in this petition is made to the recovery certificate issued under the Uttar Pradesh Public Moneys (Recovery of Dues) Act, 1972. The petitioner was licensee of the Indian made foreign liquor shop at Gairsain. There were certain dues against him. Therefore, recovery has been made, which is impugned herein. Heard. Learned counsel for the petitioner submits that the petitioner intends to deposit the money in installments. Therefore, he may be given time to deposit the money. The petitioner is admittedly under obligation to pay the amount and recovery proceedings have been initiated against him. This Court has no information or data with regard to the financial capacity of the petitioner. This Court may not fix any timeframe or installments for payment of the money. The recovery has been proceeded for payment of the dues against the petitioner. Therefore, no interference is warranted. Accordingly, the writ petition is dismissed. However, if the petitioner requests the authorities to pay in installments, this Court has no doubt that such request may be considered, provided the petitioner expresses such intention by depositing a substantial portion of the outstanding dues.
