D NATH (GA, ASSAM, R- 4), SC, APDCL BEFORE HONOURABLE MR. JUSTICE SANJAY KUMAR MEDHI ORDER 04.08.2025 Heard Shri I.A. Talukdar, learned counsel for the petitioner. Also heard Shri R. Bora, learned Standing Counsel, APDCL and Shri J. Handique, learned State Counsel for the respondent no. 4. The claim in this writ petition was with regard to a compensation of Rs.25,00,000/- for the death of the son of the petitioner with the allegation of electrocution. It is alleged in the writ petition that the deceased was about 10 years of age and a student of Class-IV when he had met with the accident of electrocution by connecting with an electric pole. The petitioner has alleged negligence. Shri Talukdar, learned counsel for the petitioner has however fairly disclosed that the client is not in touch with him for a long period of time. Shri Bora and Shri Handique, learned counsel for the respondents have however submitted that compensation for electrocution is under a particular scheme where an amount is specified. There is also a requirement to make a fact verification exercise by the Senior Electrical Inspector, Government of Assam. Since the learned counsel for the respondents are not equipped with the instructions, this Court is of the opinion that the writ petition be closed with a direction that, if any claim is pending, the same be considered in accordance Page No.# 3/3 with law with the existing scheme for grant of compensation The writ petition accordingly stands closed.
