ORAL JUDGMENT (PER: HON'BLE MR. VIBHU BAKHRU, CHIEF JUSTICE)
1. The appellants have filed the present appeal impugning an
order dated 10.02.2025, whereby the learned Single Judge has issued notice in the writ petition being WP.No.37187/2025 filed by the appellants. The appellants have filed the said petition impugning the recruitment process for the post of Junior Assistants

and Attenders pursuant to a notification dated 16.08.2025 [impugned notification]. The appellants are aggrieved inasmuch as their plea for an ad interim order for staying the impugned notification was not acceded to. 2. The respondents had commenced the process for recruitment to the post of Junior Assistants and Attenders in terms of the impugned notification. The appellants are aspirants for the said posts and had participated in the recruitment process. 3. It is to be noted that in terms of the impugned notification, applications were invited for 62 posts of Junior Assistants and 12 posts of Attenders. The appellants had furnished their application and had also paid the examination fee. Thereafter, they were issued the examination tickets and the appellants had appeared for the examination, which was conducted by the respondent, (Bangalore City Co-operative Bank Ltd.,) on 19.10.2025. 4. Thereafter on 04.12.2025, the results of the examination were declared and the appellant Nos.1 to 4 had obtained the following marks: (i) appellant No.1 – 82 marks;

(ii) appellant No.2 – 79 marks; (iii) appellant No.3 – 69 marks; and (iv) Appellant No.4 - 64 marks. 5. The cut off was fixed at 116 marks. 6. The appellants, who have now been declared unsuccessful, have raised a challenge to the recruitment process, in which they had participated without any reservation. 7. The appellants’ challenge to the recruitment process under the impugned notification is founded on several fronts. First, they claim that the impugned notification is voilative of the statutory rules, the notification does not contain any reservation matrix for schedule castes, schedule tribes, women and other backward classes. Second, that the impugned notification does not specify the category-wise breakup of posts. Third, that the impugned notification did not specify the cut-off marks. And fourth, that the impugned notification did not disclose the evaluation process. 8. The appellants also seek to challenge the evaluation on the ground that third party agency was engaged.
And, it also did not

publish the standard operating procedures, transparency guidelines and evaluation process or selection methodology. 9. There is no material on record to indicate that the appellants had sought any clarification in this regard prior to participating in the examinations. 10. At this stage, we refrain from making any observations in regard to the aforesaid grounds as the appellant's writ is pending before the learned Single Judge. However, considering that the appellants had not raises these issues at any stage prior to filing the writ petition or prior to participation in the examination and have sought to raise the same only after they have been declared unsuccessful in the examination; we do not find any fault with the decision of the learned Single Judge in not granting any ad interim
order prior to hearing the respondents.
11. The appeal is accordingly dismissed.
