At the outset, it is submitted by Mr.Abishek Moorthy, learned Government Advocate, appearing for the respondents, that the writ petition is premature, inasmuch as there is no refusal slip and there is nothing to indicate that the Preliminary Decree was even presented before second respondent. In any event, he would submit that it is always open to the petitioner to present/re-present the above decree and, on such presentation/re-presentation, the same would be considered and registered, if it is otherwise found to be in order. 3. In view of the above, the petitioner is directed to present/re- present the above Preliminary Partition Decree before second respondent and, on such presentation/re-presentation, second respondent shall register the same, if it is otherwise found to be in order.
