HC-KAR NC: 2025:KHC:49257 CRL.P No. 15794 of 2025
Koramangala for the offence punishable under Section 417, 418, 420, 465, 468 and 471 of IPC. Undisputedly, the police on completion of investigation has filed a ‘B’ report, based on the
order passed by this Court in W.P.Nos.49023-49025/2016 and W.P.Nos.49258-49260 of 2016 disposed on 05.04.2017.
3. It is pertinent to mention that W.A.No.905/2019 filed by the State against the said order was also dismissed vide order dated 01.07.2019 as not maintainable. No further steps are taken by the State to challenge the order passed by the learned Single Judge and therefore, the order therein has attained finality.
4. In spite of filing of ‘B’ report by the Police, the learned Magistrate has not passed any order on the said ‘B’ report as on today. Hence, the grievance of the petitioner seems legitimate and justified. A necessary directions have to be therefore, issued to the jurisdictional Magistrate. Accordingly, the following:
