ORDER:
THE HONOURABLE SRI JUSTICE K SREENIVASA REDDY CRIMINAL PETITION NO: 1754 OF 2025 This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/accused, seeking bail in Crime No.ll/2025 of Butchireddypalem Police Station, SPSR Nellore District. 2. A case has been registered against the petitioner for the OffenCeS punishable under Sections 85 and 108 of B.N.S.
3. Case of the prosecution, in brief, is that the deceased namely Narmada is the elder sister of the 'lnformant. The informant gave complaint to police on 12.01.2025 at 9.OO pm stating that the deceased fell in love with the petitioner/accused and married him about 12 years ago and they were blessed with a son. The deceased was working as a Secondary Grade Teacher in a Government School at Peddapariya Village prior to her death and the petitioner is working as Salesman in Muthoot finance, Nellore. Later, the petitioner addicted to alcohol and developed illegal intimacy with one Rama of his village and started harassing the deceased. v whenever the deceased went to school, the petitioner used to bring said Rama to his house. on knowing the same, the deceased questioned the petitioner. On that, the petitioner beat the deceased and scolded her. The deceased informed the same to her grandmother and also to the informant. 2 // on 12.01.2025, when the petitI'Oner left home WI-th his SOn, the deceased committed suicide by hanging herself to a ceiling fan with a saree. 4. Heard, Perused the record. 5. Learned Assistant Public Prosecutor submits that major part of the investigation is completed except filing of charge sheet. 6. A perusal of the material available On record goes tO Show that the I. petitioner is the husban'\d of the deceased. Thereafter the deceased informed the informant herein that the petit-loner was having illicit intimacy with one lady namely Rama. It is further alleged that the petitioner was addicted to alcohol and harassed the deceased. An altercation took place between them and two weeks thereafter the deceased said to have committed suicide. To attract an offence under Section 108 B.N.S., it is essential that all the ingredients Of SectI'On 85 of the B.N.S. have to be satisfied that there should be an intentional aiding in driving a Person tO commit suicide.
ln the present case on hand, it is stated in the report that the petitioner is having illicit intimacy with one lady namely Rama. Except the bald allegation, Pr,lma faC,'e there iS nO Other allegat'lon. The petitioner/accused is in judicial remand from 16.01.2025 i.e. for more than 34 days. 7. ln View Of the aforesaid facts and Circumstances Of the Case, this court is inclined to grant bail to the petitioner here-ln, on the following conditions. (i) The petitioner/accused herein Shall be released on his executing a personal bond for Rs.10,000/-(Rupees ten thousand only) with two sureties for a like sum each to the satisfaction of the Additional Judicial Magistrate of First Class, Kovur; (ii) on release, the petitioner shall appear before the Station House officer concerned on every Sunday in between 10.00 a.m. and 05.00 p.m., till filing of charge sheet. 8.
