This writ petition has been filed with the following prayer; "(i) Issue a writ order or direction in the nature of MANDAMUS commanding and directing the respondents to remove the illegal encroachment from the encroachers upon the Khasra No. 163, area 0.2740 recorded in the revenue report as (pond) situated at Village Variyawan, Tehsil-Handia, District- Prayagraj who is allotted in favour of petitioner for 10 years. (ii) Issue a writ order or direction in the nature of MANDAMUS direct the respondent no.2 to decide the representation of the petitioner dated 26.6.2025 within stipulated period as fixed by this Hon'ble Court." 2. It is contended that fisheries rights have been settled in favour of petitioner but he is not permitted to do the same as the pond in question has been encroached by some private persons. An application has been moved by petitioner on 26.6.2025 before the respondent No. 2, which is pending consideration. 3. As no useful purpose would be served in keeping the matter pending or issuing notice to the private respondents, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit, with a direction upon respondent No.2 to decide the application dated 26.6.2025 moved by petitioner, in accordance with law, after hearing all affected parties, preferably within a period of one month from the date of production of certified copy of this order. 4. With the aforesaid direction, present writ petition stands disposed of. 5. It is made clear that this Court has not adjudicated the case on merit.
